ORDINANCE NO. 267 BUENA VISTA CHARTER TOWNSHIP COUNTY OF SAGINAW, STATE OF MICHIGAN BUENA VISTA CHARTER TOWNSHIP MUNICIPAL SANCTIONS FOR ORDINANCE VIOLATIONS ORDINANCE An Ordinance to provide for the use of Municipal Civil Infractions as penalties for the violation of specified Buena Vista Charter Township Ordinances, and to provide for the civil penalties therefore. Buena Vista Charter Township, Saginaw County, Michigan hereby ordains: SECTION 1 TITLE OF ORDINANCE This Ordinance shall be known and cited as the Buena Vista Charter Township Municipal Sanctions for Ordinance Violations Ordinance. SECTION 2 ORDINANCES AFFECTED The ordinances of the township which are affected by this ordinance are as follows:

Penalties for all Zoning Violations

  SECTION 3 CIVIL INFRACTION FINE The referenced sections included in Table 1 are hereby amended by deleting that portion of the section which provides for punishment as a misdemeanor, and replacing it with the following: Any person or other entity who violated any of the provisions of this Ordinance is responsible for a municipal civil infraction as defined by Michigan law and subject to a civil fine

determined in accordance with the following schedule:


lst Violation within 3-year period *


2nd Violation within 3-year period *


3′d Violation within 3-year period *


4th Violation within 3-year period *


  *DETERMINED ON THE BASIS OF THE DATE OF VIOLATION(S). Additionally, the violator shall pay costs, which may include all direct or indirect expenses to which the Township has incurred in connection with the violation. In no case, however, shall costs of less than $9.00 or more than $500.00 be ordered. A violator of this Ordinance shall also be subject to such additional sanctions, remedies, and judicial orders as are authorized under

Michigan law. Each day a violation of the Ordinance continues to exist constitutes a separate violation. SECTION 4 REPEAL All Ordinances, or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 5 SEVERABILITY The provisions of this Ordinance are hereby declared to be severable and if any part is declared invalid for any reason by a court of competent jurisdiction it shall not affect the remainder of the Ordinance which shall continue in full force and effect. SECTION 6 EFFECTIVE DATE This Ordinance shall take effect 30 days after publication as required by law following adoption by the Township Board.
